These characteristics are expressly brought to the Buyer\u2019s attention and do not constitute defects or non\u2011conformities.<\/p>\n\n\n\n<p>MiniMorph Sculpts\u2019 miniatures are collectible and hobby items intended exclusively for adult customers. They do not qualify as toys under Directive 2009\/48\/EC and are not intended for children.<\/p>\n\n\n\n<p>Each product is described in detail. Photographs are as accurate as possible but are not contractually binding.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 4 \u2013 Pre\u2011contractual Information<\/h3>\n\n\n\n<p>Before any order, the Buyer acknowledges having read and understood:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the essential characteristics of the products,<\/li>\n\n\n\n<li>their price,<\/li>\n\n\n\n<li>shipping costs,<\/li>\n\n\n\n<li>delivery times,<\/li>\n\n\n\n<li>and these Terms.<\/li>\n<\/ul>\n\n\n\n<p>This information is made available clearly and understandably to the Buyer, in accordance with applicable consumer protection laws.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 5 \u2013 Orders on WooCommerce<\/h3>\n\n\n\n<p>The Buyer may place an order:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>as a guest,<\/li>\n\n\n\n<li>or by creating a personal customer account.<\/li>\n<\/ul>\n\n\n\n<p>Creating an account allows the Buyer to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>access order history,<\/li>\n\n\n\n<li>check order status,<\/li>\n\n\n\n<li>manage personal information.<\/li>\n<\/ul>\n\n\n\n<p>The ordering process comprises the following steps:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Product selection and addition to cart<\/li>\n\n\n\n<li>Cart review<\/li>\n\n\n\n<li>Entry or confirmation of delivery details<\/li>\n\n\n\n<li>Selection of shipping method<\/li>\n\n\n\n<li>Selection of payment method<\/li>\n\n\n\n<li>Acceptance of Terms<\/li>\n\n\n\n<li>Final confirmation and payment<\/li>\n<\/ol>\n\n\n\n<p>Order validation constitutes the formation of the sales contract.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 6 \u2013 Prices<\/h3>\n\n\n\n<p>Prices are shown in Euros (\u20ac), all taxes included (TTC).<\/p>\n\n\n\n<p>MiniMorph Sculpts is not subject to VAT pursuant to Article 293B of the French General Tax Code. Therefore, VAT does not apply.<\/p>\n\n\n\n<p>Prices do not include shipping costs, which are added at checkout.<\/p>\n\n\n\n<p>MiniMorph Sculpts reserves the right to modify prices at any time; the applicable price is that in effect on the date of the order.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 7 \u2013 Payment<\/h3>\n\n\n\n<p>Payment is due immediately at the time of order.<\/p>\n\n\n\n<p>Accepted payment methods:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Credit card<\/li>\n\n\n\n<li>PayPal<\/li>\n<\/ul>\n\n\n\n<p>Payments are processed via secure platforms. MiniMorph Sculpts never has access to the Buyer\u2019s banking details.<\/p>\n\n\n\n<p>Orders with unconfirmed payment will not be processed.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 8 \u2013 Order Confirmation<\/h3>\n\n\n\n<p>Once payment is validated, the Buyer receives an order confirmation email summarizing:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the products ordered,<\/li>\n\n\n\n<li>the price,<\/li>\n\n\n\n<li>the delivery address,<\/li>\n\n\n\n<li>these Terms.<\/li>\n<\/ul>\n\n\n\n<p>Records stored by WooCommerce serve as proof of the transaction.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 9 \u2013 Delivery<\/h3>\n\n\n\n<p>Products are delivered to the address indicated at the time of order.<\/p>\n\n\n\n<p>Delivery is carried out via:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mondial Relay (tracked pickup point),<\/li>\n\n\n\n<li>or tracked home delivery.<\/li>\n<\/ul>\n\n\n\n<p>Delivery times are indicative. If delivery is delayed by more than 30 days, the Buyer may request contract termination and a full refund.<\/p>\n\n\n\n<p>Risk of loss or damage passes to the Buyer upon handover to the carrier.<\/p>\n\n\n\n<p>The Buyer must check the condition of the parcel on receipt and report any damage to the carrier within three (3) days.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 10 \u2013 Right of Withdrawal<\/h3>\n\n\n\n<p>In accordance with applicable consumer protection law, the Buyer has the right to withdraw from the contract within fourteen (14) calendar days from the date of receipt of the order.<\/p>\n\n\n\n<p>Return shipping costs are the responsibility of the Buyer.<\/p>\n\n\n\n<p>Products must be returned in perfect condition, complete and undamaged.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 11 \u2013 Refund<\/h3>\n\n\n\n<p>Where withdrawal is validly exercised, MiniMorph Sculpts will issue a refund within fourteen (14) days of receiving the returned products.<\/p>\n\n\n\n<p>Refunds will be made using the same payment method used for the order.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/div>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 12 \u2013 Legal Warranties<\/h3>\n\n\n\n<p>Products benefit from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the legal warranty of conformity under French consumer law (L217-3 \u00e0 L217-20 articles of the French Code de la consommation),<\/li>\n\n\n\n<li>and the warranty against hidden defects under civil code provisions (1641 \u00e0 1649 articles of the French Civil Code).<\/li>\n<\/ul>\n\n\n\n<p>The consumer has a period of <strong>two (2) years<\/strong> from delivery to exercise the legal warranty of conformity.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 13 \u2013 Liability<\/h3>\n\n\n\n<p>MiniMorph Sculpts cannot be held liable for indirect or immaterial damages resulting from use of the Site or the Internet, including service interruption or data loss.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 14 \u2013 Personal Data (GDPR)<\/h3>\n\n\n\n<p>MiniMorph Sculpts collects only personal data necessary for order processing and commercial relations.<\/p>\n\n\n\n<p>Data is retained for as long as necessary for the purposes for which it was collected.<\/p>\n\n\n\n<p>In accordance with the EU General Data Protection Regulation (GDPR), the Buyer has the rights of access, rectification, erasure, restriction, objection, and data portability.<\/p>\n\n\n\n<p>Requests can be sent by email to <strong><a href=\"mailto:minimorph.sculpts@gmail.com\">minimorph.sculpts@gmail.com<\/a><\/strong> or by mail at the following address:<br><strong>MINIMORPH SCULPTS \u2013 David Lefebvre \u2013 1611 route de Meylan, 38330 BIVIERS<\/strong>.<\/p>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\">Article 15 \u2013 Intellectual Property<\/h3>\n\n\n\n<p>All elements of the website <strong><a href=\"http:\/\/www.minimorphsculpts.com\/en\/\">www.minimorphsculpts.com<\/a><\/strong> remain the exclusive intellectual property of MiniMorph Sculpts.
